Thales Approaches Delhi High Court On Scorpene Deal PIL2007-04-19 Thales, a French defence company which manufactures the Scorpene submarine, today approached the Delhi High Court seeking permission to oppose the petition which challenged the Indian government's deal to acquire these submersible vessels."I want to demonstrate before the court that all the allegations are wrong and there is malafide behind it," a counsel appearing for the company said before a Bench comprising Justices T S Thakur and S N Agrawal. Thales has moved an application seeking to be made a party in the petition filed by an NGO, CenPublic Interest Litigation (CPIL), which has alleged that there was an involvement of middlemen in the submarine deal and that the government should not have any defence deal with it till the investigations were over. The French company's plea for impleadment in the ongoing matter was opposed by the NGO, which contended that investigation was still against the company and until the FIR was filed, it could not be made a party. "It has no right at this stage. The Supreme Court has laid down the law which clearly says that if the rights of a party is affected by investigation then it cannot be heard in the Court until FIR is filed," advocate Prashant Bhushan appearing for the CPIL said. However, the Centre supported the company's contention that it be heard in the case and Additional Solicitor General Gopal Subramanium said, "In the ongoing investigation in the Navy War Room Leak case nothing about the said transaction had come out and if something comes out on the surface I would certainly inform the Court." The Court on, April 4, had sought explanation from the CBI over it's failure to take action on a complaint filed by the NGO alleging involvement of some Indian middleman in the deal. Sponsored Links
